These Terms and Conditions of Use for Advertisement shall govern the usage of PhoenixSurf.com for all persons wishing to advertise their websites to the viewing members within the PhoenixSurf.com base. These terms and Conditions of Use are subject to change, therefore, Users should periodically check this page for updates and modifications. Terms and Conditions of Use modifications shall become effective upon publication and shall be binding upon all Users for any and all usage subsequent to the published change. Violation of these Terms and Conditions of Use shall be grounds for suspension or termination of advertising privileges and deletion of Users account.

PhoenixSurf.com functions as a traffic exchange medium where business professionals may advertise their websites for any and all products and services, except those that are in violation of the Surf Rotation Agreement. These prohibited sites shall include: Websites with Adult Content, Offensive or Racially insensitive materials, auto installers, hate sites, war mongering sites, frame freezers, rotator sites, redirector sites, dialers, subscription e-mail, multiple or viral pop-ups, frame breakers, or any site deemed unacceptable at the sole discretion of the reviewing Admin personnel of PhoenixSurf.com. PhoenixSurf.com shall have sole discretion in the approval or denial of any site, and shall be under no contractual obligation to communicate or explain its decisions to denied Users.

A potential User may register for free to view the site and explore. However, to place a site in the Surf Rotation for viewing by other members, a Registered User must purchase an Advertising Package. Failure to purchase an Advertising Package within 30 days of registration shall be deleted from the system and denied access. This procedure is necessary to maximize the advertising return potential for those members that have purchased Advertising Packages.

When a member purchases an Advertising Package, that member's website shall be placed into the Surf Rotation to be viewed by other Users. Said site will appear on a Users screen for a period of 15 seconds at a time, and go through the Surf Rotation to be viewed on the basis of one "hit" or viewing per unit of their Advertising Package purchase. These "hit" credits may be allocated by the User to promote the website of their choosing. Purchaser of Advertising Package shall be granted one credit per unit purchased. Upon consumption of these credits, through the viewing of others through the Surf Rotation, more credits may be purchased by the user by purchasing additional Advertising credits in their User's account. A User will not be allowed to purchase more than two or within 8 days, utilizing EST,. A User may purchase a maximum of two concurrently running Advertising Packages. The total sum of the Advertising Packages purchased at any time may not exceed $6,000 U.S., and must be purchased in increments of $8 U.S.. All purchases must be in U.S. dollars, and PhoenixSurf.com shall not be responsible for any currency conversion.

Advertising Users may also earn "hits" to their website in the Surf Rotation by viewing other members sites. (See Viewing Terms and Conditions of Use below).

PhoenixSurf.com in no way guarantees that an Advertising User will gain business or income as a result of this advertising. It is understood that the User freely chose this method of advertising for their products or services and undertook the financial risk of such advertising without inducement or promise of financial gain. The User understands that they are purchasing web advertising and web traffic only and no other warranties of any kind whether implied or express exist.

Advertising User may track the "hits" that their website has obtained through their own back office provided through the PhoenixSurf.com system. They may also track advertising credits and direct and promote websites as they deem fit, within the allowable site under these Terms and Conditions of Use. No advertising credits will be allocated to websites automatically, it is the sole responsibility of the User to manage and allocate their advertising credits.


Advertising Viewing Terms and Conditions of Use

After purchasing an Advertising Package as an advertiser, User is provided with an optional opportunity to earn 15% per day for a period of 8 days of their purchased Advertising "Advertising Package" purchase price. This is done by agreeing to and viewing the advertisements of other Users.

To participate, User must login to their personal back office and begin viewing the ads of other Users. User must view 15 sites per calendar day, using Eastern Standard Time as the measure. Each site will run for a period of 15 seconds and than change automatically to another site in the Surf Rotation. User must actively view the ads, it is a violation of these Terms and Conditions of Use to let the ads run without actively viewing them. As a User, other Users expect the same courtesy and respect for their ads that you expect for your own.

If a User views more than 15 ads and up to a maximum of 30 ads per calendar day, User may earn additional Advertising credits, which may be used toward additional "hits". Under no circumstances may User earn in excess of 15% commission for watching ads. In addition, no additional "hit" credits will be allowed over and above the 30 ad per day viewing limit.

In order to earn a commission, User must have a currently active Advertising Package. The purpose of this bonus program is to reward advertisers for viewing and visiting the products and services of other Users, thus creating an internal network beneficial to all User and their businesses.

All "Advertising Packages" are good for a period of 8 consecutive days. At the end of the 8th day, at 12:00 a.m E.S.T. all "Advertising Packages" will expire. Upon the expiration of an "Advertising Package" the PhoenixSurf.com system will automatically generate a message requesting payment instructions from User. The User has two payout options:

1. Standard Payout Option

a. Under the Standard Payout Option, PhoenixSurf.com shall make a direct payment with the Payment Processor that User used to purchase their Advertising Package. Such payment will be made within 7 business days of expiration of the Advertising Package.

b. Under the Standard Payout Option, there is no maintenance fee and is subject to normal Payment Processor fees only.

2. Fast Track Payment Option

a. Under the Fast Track Payment Option, the User may choose in advance to have the payment expedited within 48 hours of expiration of the Advertising Package.

b. Under the Fast Track Payment Option, there is a fee deducted from the payment which is tiered in its percentages, which shall be deducted prior to payment automatically.

All payments shall be handled and paid by PhoenixSurf.com and shall be conducted in an efficient and professional manner. Under unusual circumstances, beyond the control of PhoenixSurf.com a payment may be delayed, but PhoenixSurf.com will work expeditiously for the benefit of Users to minimize and correct any delay issue. PhoenixSurf.com will notify User is any unforeseeable delay occurs and keep them apprised of any situation.


Fast Track Rates:

$8.00 to $3,000.00 = 5%

$3,001.00 to $4,500.00 = 6%

$4,501 to $6,000.00 = 7%

$6,001.00+ = 8%

In the unlikely event that any or all payment processors in use through the PhoenixSurf.com organization are frozen, suspended, closed down, or otherwise interfere with the ability of PhoenixSurf.com to process or pay Users, it is understood and agreed by Users that this activity is out of the control of PhoenixSurf.com and PhoenixSurf.com shall not be liable for any delay or loss suffered by User. User agrees to hold harmless PhoenixSurf.com for any actions by or against Payment Processors that may affect the ability of PhoenixSurf.com to pay the Users.

In addition to the optional viewing program provided by PhoenixSurf.com to its Users, PhoenixSurf.com also offers an additional "Advertising Referral" program. This program allows active Users with Advertising Packages currently running to earn additional income by referring other advertisers to the service. Referrals must be directed to the program through the User's specific individual referral link to qualify. For all Referral accounts, the User shall receive a commission of 8% for each and every Advertising Package purchased by Referral. This bonus commission shall continue each time Referral purchases any additional Advertising Packages, for as long as Referring User maintains an active Advertising Package as well.

Free User Accounts

Users are under no obligation to purchase an Advertising Package in order to view ads. Free Users may view ads of other User, but may not participate in the viewing commission program.

User acknowledges and agrees that they are participating in the program because they have a good or service to market and wish to utilize internet advertising to a localized group that has shown an interest in home based business ventures and entrepreneurial enterprise. Any promises or guarantees that may have been made to anyone reading these Terms and Conditions are not the statements of PhoenixSurf.com and should be ignored. Any purchase is for the right to obtain viewership of User's ads/website, and purchase is made for no other reason.

User is responsible for reporting to appropriate authorities any income which they may derive from their ancillary participation in this program. Any tax related questions or matters should be discussed by User with a licensed tax professional.

The names, likeness, logos, and trademarks of PhoenixSurf.com, including but not limited to the website, design, banners, navigational tools, and overall functionality of the site are protected by United States trademark and copyright laws, and should not be used, copied or otherwise reproduced without express written consent of PhoenixSurf.com.

PhoenixSurf.com has no control over the internet. User acknowledges this simple fact, and further acknowledges that PhoenixSurf.com can not control the quality, safety, or legality of the content or information submitted by Users to this website. Due to the unfeasibility of authentication of Users on the internet, PhoenixSurf.com does not and cannot verify or confirm that each User is who they purport to be. The User agrees to release PhoenixSurf.com, its officers, directors, employees, and affiliates from any and all claims, demands, or damages, either actual or consequential, direct or indirect, implied or express, of every kind and nature, known or unknown, suspected and unsuspected, disclosed or undisclosed, arising out of or in any way connected with User's relationship with PhoenixSurf.com.
