Herbalife International, Inc. and certain of its independent distributors continue to face a class action in the Los Angeles County Superior Court in California.

On Feb. 17, 2005, a suit, "Minton v. Herbalife International, et al.," was filed in the Superior Court of California, County of San Francisco. The suit was served on the company on Mar. 14, 2005. The company moved to transfer the case to the Los Angeles County Superior Court.

The suit is challenging the marketing practices of certain Herbalife International independent distributors and the company under various state laws prohibiting "endless chain schemes," insufficient disclosure in assisted marketing plans, unfair and deceptive business practices, and fraud and deceit.

Plaintiff alleges that the Freedom Group system operated by certain independent distributors of Herbalife International products places too much emphasis on recruiting and encourages excessively large purchases of product and promotional materials by distributors.

Plaintiff also alleges that Freedom Group pressured distributors to disseminate misleading promotional materials. Plaintiff seeks to hold the company vicariously liable for the actions of its independent distributors and is seeking damages and injunctive relief.

I became a supervisor with herbalife june 12 2004. When I first started the business I was told that I could make so much money in the business in so many months and had the opportunity to become successful. As soon as I signed up there were alot of problems.

The first problem I had was paying for the the IBP pack. They said that if I purchased the pack that it would put me into business, which wasn't true also they would go over the items with me, which wasn't true either. Then they asked me if I had about three grand to invest in the business.

The website which is $200 dollars and $1200 dollars For wheel slots,and a grand to become supervisor. All together I needed at least $5,000 and when I only came up with Half The support just left.

I still continued to make It work without anyone I wasn't fully trained to talk to people, I tried to pay for my loan I took out to start the Business, And was unable to. I lost over $2,000,lost out on time for school, time with my family and emotional stress from the long hours I put in.

I'm also very skeptical about starting a business now. I'm still a member and need some direction or input. I believe I should be compensated for my losses. If there is an attorney out there please contact me!

In addition, GOLS and its participants — through its Web sites and other promotional materials — recruited new participants by exaggerating income expectations without disclosing the income of a typical participant.

"Those who join pyramid schemes are often enticed by promises of easy money, but only the very few at the top ever see any real benefit," said Raymond Pierce, Deputy Commissioner of Competition. "The Bureau is committed to pursuing these offences under the Competition Act and ensuring that Canadians do not fall prey to such scams."

According to the Prohibition Order, Global Online Systems Inc. and its directors, Deborah Jane Stoltz and Marilyn Thom, have agreed to:

* pay a $150,000 fine;
* disclose the average income actually received by all participants in GOLS;
* inform all of its existing distributors and participants of the terms of the Order; and
* not become involved directly or indirectly in any business operation engaged in a scheme of pyramid selling.

I recently read with ambiguous emotions of dismay and gratitude that Global Online Systems was fined $150,000 for operating an illegal pyramid scheme. I was personally bilked for about $13,000 and I "recruited" many others who lost a great deal of money as well; in fact one client accrued $15,000 worth of debt over this "lucrative" home-based business opportunity. We were continuously told to invest more and more and more money into advertising, and advised that our businesses were failing because "we weren't spending enough on advertising."

I want to advise people that in September of 2004, a large group of Global Online Systems members branched off as Online Business Systems; this group is spearheaded by Shawn Dahl and Glenn Kirkpatrick. They have a new website, but utilize the exact same tactics and scripts that Global Online Systems used. Verbatim.

I started this business with Global Online Systems around August 2003 and got out of the business in October 2004. Basically, I was forced out by a key member, namely Phil Keogh, because "my organization was complaining too much" about the inordinate expenses each month for leads (getting forced out was actually a blessing in disguise). For example, giving $1000 in advertising to these clowns at the beginning of each month, we would receive 8 to 10 leads (at the most 12), some of which weren't even legitimate credit card numbers to process. (They now have a clause on their website indicating the "advertising is not guaranteed" in any way shape or form, which protects them from any liability.)

Many, many, many people have lost thousands and thousands of dollars given to these scam artists at the beginning of each month for what they call "group advertising" or the "internet marketing wheel."

I just thought that perhaps people might want to be made aware of this, and that Online Business Systems should be part of the ongoing investigation into illegal pyramid schemes as well. These people are representing Herbalife International, and I have found that these products are extremely overpriced and difficult (if not impossible) to reasonably market. In addition, in order to participate in certain Fast Track or Focus Groups (which is where the awesome training occurs that is supposed to practically guarantee business success), they require that a client be classified as a "Supervisor" with Herbalife (this is typically a $3,800 investment) and also have at least one internet wheel slot (cost of $500 per month for each slot; they strongly encourage us to buy three per month for a total investment of $1,500!!). Plus, you are required to purchase those Decision Package kits ($180 in lots of ten) and Operations Manuals ($120 in lots of 5) and Training Tickets ($150 in lots of five) in order to do the friggin' business. Furthermore, Herbalife dings the hell out of you for shipping, handling and tax for every order that you place!

In hindsight, this whole scheme is utterly ridiculous! Where are all those advertising dollars going each month??? There is absolutely no accountability financially for these invested dollars. It's based on a factor of trust and faith. What a scam! No one that I know of made any money (and several of us tried really, really hard); rather, we all accumulated a massive amount of debt.

Many of the people that I recruited, including myself, genuinely tried to make this business work. We believed in the system and what we were being told, however, we all lost a lot of money. Most of the debt we incurred ranges between $7,000 and $15,000!! It's bad enough that I got myself into a very serious financial crisis, but frankly, I'm living with a lot of guilt now because I got many other people in the same exact boat. And for that I'm very sorry. I was just as naive as them and certainly didn't intentionally try to hurt anyone. I am now a very cynical person because of this experience, and I never was before. I was always sought out the best in people, tried to help everyone in any way I could, and generally believed that the majority of folks were decent.

Furthermore, all of the clients that I was ever involved with were from the U.S. Perhaps these guys are protected under some international guidelines, which is why they typically dealt with people out of Canada. I don't know.

Bottom line: Don't get wrapped up in this deceptive business!! It's not a business really, just brainwashing tactics to get you in deep enough financially; then you are compelled to stick with it, hoping to get out of debt and achieving those ambitious financial goals that you're continuously promised will happen with perseverence and consistency. This is a really bad business venture!! Take my word for it. All you really need to do is objectively (the operative word here is "objectively") consider the tactics that are being employed. In hindsight, it's very evident. Frankly, I can't believe I was affiliated with a group like this for so long. I have a master's degree in business management and considered myself business savvy.

This has been very helpful to me, being new to the online internet business and to this site. I only wish I had come across it sooner; (about 2 weeks ago.)
I have been wanting to be able to work from home, since I live with my 85 year old mother and have just recently graduated from college. I came across an internet ad on "Work from Home" I filled out a form and am not sure but may have spent approx. $48.95 including postage & handling on the decision package. I listened to the DVD & CD, read the information, sounded good to me, and called the name given on the package, my Personal Coach. We have been in contact with one another since 3/24/05. After our first phone call I was asked if I was interested and than told I needed to spend another $399.00 for the IBP. I was not to go through the box until I had talked to my Personal Coach and another upline team member. A couple of days later they called and proceded to go through the material with me- Herbalife Products, vitamin & nutrient supplements plus the Online Business Operations Manuel. I was given another assignment and they called back about 2-3 days later. Eventually I purchased the "Supervisor" volumn points of 4000 to become a qualified supervisor, I have yet to sell anything. This cost $3700 since now being a supervisor I would get a 50% discount. Along with this was included a $125.00 website for me to advertise on( 25.99 per month) Which I see is pretty much the same website for all. I have had few hits on it, but am told that if I buy into "The Wheel" for at least $1000.00 I may get some leads, not guaranted. Now orginally I thought spending $48.95 is not too bad,but now it is up to $4147.95 total spending on my credit card for this "Work from Home" businesss and I haven't even really got started. I am getting suspicous. I read the story posted here on the Ottawa, Canada incicident on a Better Business Bureau site from Utah. I was horrified, when I contacted the upline team member about it she excused it by writing me, "Don't believe everything you read over the Internet!" She's been in the business longer than I have and has seemed to make much money with it, she told me $47,000 in one week! So I don't want to argue with her. But I really can't afford to put anymore money into it and now I have 4 boxes of products that I am afraid I am stuck with. From what I have read others have lost more, but still I have student loans to pay back besides now the extra expenses I charged on my credit card. Is there any action I can take or should I just chalk it up to a "learning experience" in life? The upline team member also informed me that the www.herbalcoach.com website is not one she would recommend."I'd rather you stay away from Herbalcoach. Look at our retail websites. attached is info about them."

from. The Online System, as we have discussed, is an "arm" where we have
these websites, etc. already set up. This Herbalcoach is not nearly as
developed (in terms of reporting, tracking, etc.), compared to the system we
have. The Online System group was the highest growth "arm" of Herbalife
last year! That's us!!!"

It seemed all right to me since it is very inexpensive.

Networx Online advertising practices is suspect at glance, deceptive in nature, and not transperent in representing themselves or their client. We will contact customer to clarify. -- Hi: NetworxOnline is similar to a web hosting company who provides a contact manager and web hosting services to many clients. We will contact Scrub to ask him for more details of the 'accounting manager' advertisement that he is complaining about. Networx Online is not seeking an accounting manager and never has. This advertisement is not ours. I believe that Scrub is either confusing our company with another company, or should be directing his comments to one of the 1000's of individuals and/or companies that host websites with us. I will post more information once I have the opportunity to hear from the person making the complaint. If their complaint is with one of our customers, then I will provide him with the appropriate contact information so that he can resolve the issue with the correct party. Thank you. NetworxOnline can not have it both ways. They can not claimed it is a customer /client misrepresenting their product and at the same time have their address as contacts I admitt that I error when I mentioned Accounting Manager, I should have written advertisements posted in the Accounting Sections of Monster.com and CareerBuilder.com. If a client of theirs is using Networx Online name inappropriately, I suggest that John Rydell contact the customer or client and make sure that the client advertisements include the client corporate name contact information rather than THE ONLINE BUSINESS SYSTEMS. The domain name is owned by Networx Online.

The domain for www.theonlinebusiness.com is not owned by Networx Online. Feel free to check any of the WHOIS listings. Networx Online provides hosting and contact management services to TheOnlineBusiness. We do not do advertising for them and we do not post advertisements on careerbuilder or monster. The person who is 'complaining' about Networx Online seems to be attempting to dig up information which is being posted on various message boards. They have not done business with Networx Online and so they have no financial dispute with our company. Tthe person complaining is upset with careerbuilder, monster, and the online business -- Not Networx Online

Just for your information, there are many companies that market Herbalife products. The Online Business System is one of them. I cannot tell you about that company. I know that from some of the experiences I have read I would have some questions about what they are doing. All of the companies have an autoresponder system but if you request to be taken off the law says they must. Every company that markets Herbalife uses a variety of methods to advertise and recruit - some ethical some not very. Herbalife itself as a company does not have any purchasing requirements but again there are some who tell you there are. Herbalife will drop ship all your orders so you pay for the product when you place the order thus not having to actually keep an inventory of products. To reach certain discount levels you can either purchase the product personally or sell product to reach that particular level. As is said by some who get involved if you can't sell the product you can at least eat your business. (That is usually meet with laughter)

The Decision Package that is sold is to eliminate the people who are not at all serious about starting a home based business. If you aren't willing to spend $40 on starting a business you aren't serious. I can't think of a single business that you can actually start and spend nothing. The package that was mentioned for $399 includes the business license and a month's worth of product, training materials, and other things needed to get your business up and running. Yes they do not furnish a website for you like in most other business endeavors you have to pay for things. Ask McDonald's what their franchise fee is and what do you get with that. You can take a look on the internet and get sold a whole lot of stuff to set up a business.

The business is yours which means you have to advertise it and spend money. If you want a business that costs absolutely nothing to start up and run please let me know what it is. I will be the second in line right after you. That is not the real world of busin

ess. In the business world you pay for it or you borrow money to pay for it. There is not another way that I know of. If it is your business what do you expect? If it is your family what do you expect? It is yours so you have to pay for it and all that goes with it. Yes advertising, web sites, and a bunch of other stuff go into making a successful business on the internet. Not sure what is expected. Yes the whole business plan is not laid out but there are a lot of ways to sell product and get the money to advertise more and more. McDonald's sell Billions and Billions of burgers but they still advertise - a whole lot. Campaign's going on all the time. Why are they doing that when no one on the planet has not heard of McDonald's - well maybe some third world countries haven't. But they are advertsing in the good ole USA where everybody knows who they are. Well if they have to spend money to advertise then so does everybody else.

Is Herbalife a get rich quick thing - NO! But what in the world is? You have to work at anything to make it. Is selling Herbalife easy? Not really but it is being sold. Last year total sales was over $2 Billion. One web site stated in error that the yearly sales are $2 Billion. They hit $2 Billion last year for the first time. The last stat I saw on obesity in North America was at 60% - as in 60% of the population of North America is overweight. There is your marketplace - a whole lot of people. Does everyone who trys Herbalife lose weight No but nothing is 100%. How many diet plans come with a money back guarantee? I think Herbalife is either the only one or one of the few.

It has also been stated that you get paid for recruiting people. You can recruit a million people and if they sell no product you get squat! The amount of money made on the basic purchases to get you started in the business doesn't make the sponsor a whole lot of money. What makes your upline sponsor money is you selling product not buying product. If I have $10,000 dollars worth of inventory in my house and do not sell any of it then my sponsor would make money on that $10,000 and that would be it. If I sold $10,000 worth of product every month or 2 my sponsor would make a lot more money. Which do you think a sponsor really wants? And by the way if you have $10,000 worth of product in your house, you make nothing either. You have to sell the products to make money.

If your reputation had taken as many hits as the companies that market Herbalife had, you would not mention the name up front either. If I am being successful at selling the product and using the product then I will have a better chance of selling it to someone. If this type of business is not for you fine but it is not a scam! There are a great many people who are making money at it and being successful. If you think going into a business of any type is easy it is not. If it were easy everybody would be doing it. For those who are willing to work hard it can be an unbelievable way to make a living. For those who want something for nothing, I guess you can pass on the opportunity.

I am the one who started this THREAD and IS in total agreement with your comments regarding The Online Business Systems/Online Business System/Theonlinebusinesssystem/onlinebusinesssystem. This thread began by BY ASKING WHO WHERE BEHIND THE ONLINE BUSINESS SYSTEM? As it turn out, it was Herbalife product being marketed. Absolutely nothing WRONG with Herbalife products. The problem here is DECEPTION or the Lack of Transparency.
