I, Robert R. Kanuit, after being duly sworn on oath, states as follows:
1. On January 5, 2005, I received a letter from Assistant Attorney General Christian S. Walker advising that he had been contacted by a Melissa Gabrio, who indicated that she had information concerning the whereabouts of assets belonging to Michael Travis Barnett and/or Barnett & Associates, Inc., that were not disclosed in either bankruptcy filing.
2. I immediately contacted Ms. Gabrio, who advised that her husband was Michael Barnett's former gardener and had witnessed Michael Barnett making arrangements to transfer property away from Michael Barnett's residence prior to the bankruptcy filings.
3. Specifically, Ms. Gabrio advised that:
(a) Two Harley Davidson motorcycles and two enclosed trailers had been
transferred to a Greg Hartung in Crosby t Minnesota;
(b) A Chevrolet Suburban and a Chevrolet Avalanche had been shipped to West Palm Beach, Florida, by Commerce Express, Inc., in Inver Grove Heights,
Minnesota, and were awaiting shipment to the island of Nevis; and
(c) Numerous other items of property were currently in the process of being
shipped by Commerce Express, Inc., to Michael Barnett on the island of
Nevis.
4. Based on a letter filed with the Court by debtor Michael Travis Barnett's counsel, William Kampf, Michael Barnett is now permanently residing on the island of Nevis.

The above Plaintiff filed an ex parte Application seeking a Temporary Restraining Order in this Adversary Proceeding. There were no appearances.
Based upon the Plaintiff's Application, and upon all of the files and proceedings herein,
IT IS HEREBY ORDERED:
That the Defendants, and each of them, are temporarily restrained from moving, transporting, or transferring any property owned or titled in the name of Michael Travis Barnett or his wholly owned corporation Barnett & Associates, Inc., out of the United States of America, or away from any such property's current location as of the date of this Order. Defendants are further ordered to disclose the location of any such property to Trustee Robert R. Kanuit, immediately upon receipt of a copy of this Order.
This Order shall continue in effect until the Court rules on Trustee's motion for a preliminary injunction on February 2, 2005, notwithstanding the ten-day limitation contained in Federal Rule of Civil Procedure 65(b), as the Court will not be in session to consider the motion for a preliminary injunction in Duluth, Minnesota, until February 2, 2005.
